Strategic facilitation

 

The essence of the Talitha Executive proprietary model is the strategic facilitation process. This is performed, depending on the nature of the project, through periodic 1-day intensive workshops (weekly, monthly, quarterly,..)  aligned with regular interfaces with the teams and/or board. The process includes both tangible and intangible deliverables. An essential part of the model is that the client itself directs the process and conducts the activities involved.

Negotiations

 

Talitha Executive provides for a comprehensive set of services to either engage in negotiations on behalf of clients in either business transaction, internal reorganizations and with financiers and creditors or prepare teams for negotiations. Alternatively, objectives can be policy design and/or implementation, negotiations with other institutional parties with a view towards policy development, trajectory development or simply diplomat backing.

 

Always hands-on, the focus is always on impact management, execution and evaluation of negotiations. Intercultural aspects and language differences are part of the challenge.

Mediation, conciliation and representation services

 

Mediation and conciliation as part of Alternative Dispute resolutions (“ADR’) can be considered as a non-binding form of dispute resolution of commercial, private, political or society-wide issues. It also is the appropriate tool to avoid that disputes ultimately turn into conflicts. Mediation and conciliation are focused on win-win situations embedded in a formal framework. Arbitration often turns disputes into legalized conflicts and creates win-lose situations and requires the involvement of binding arbitration courts and its decisions or the normal national judiciary. Mediation can therefore be best described as a process led by a mediator where parties try to come to a mutually-agreed outcome and often takes care of the communication towards external parties that have an interest in or might be impacted by the outcome of the ongoing mediation efforts. Clients therefore never lose control over the outcome and can at any time reject solutions or terminate the mediation process.

 

In emerging markets, due to increasing levels of globalization, often the emerging judiciaries don’t hold the capacity nor specialism to deal with issues in a professional and swift manner that is business-like. Even in the developed world judiciaries are suffering from significant delays in dealing with cases where parties lose control over the outcome and focus has shifted away from the (business) objectives. Arbitration from its side, besides the costs involved, still make clients lose control over the outcome, requires running it through an arbitration court and is dominated by arbitrators (who are mostly seasoned lawyers) who turn the dispute in a legalized conflict given the nature of the procedure one has to go through.

 

Our mediation and conciliation services therefore focus on the protection or maximization of business interests without clients losing control over the process as they ultimately decide with what agreement and conditions they feel comfortable. Conciliation services differ from mediation in the sense that here the mediator can provide independent suggestions on potential outcomes or might make independent efforts to direct the talks and negotiations.

 

At any time, and although our team includes some excellent lawyers, we try to shy away from legalizing the disputes and letting it evolve towards a conflict. The economic opportunity cost is always in the background as a benchmark when judging potential outcomes. All our mediators are often not only seasoned negotiators but also business moguls that have a tight grip on evolution of business processes, industry evolution, business cultures and a decision-making culture in organizations. They are often also involved in the contract modeling in which mediation is included as the primary way of dispute resolution. Prevention disputes to arise therefore becomes the first objective.

 

Representation services are often executed for and on behalf of investors and share- or stakeholders towards the management of organizations, associations and institutions with whom they often have a fiduciary relationship or an engagement of a similar nature.
